Filing Bankruptcy to Stop Sheriff Sale on Your Home in Ohio

Receiving a notice in the mail that your home is in foreclosure and is scheduled for sheriff sale can be a frightening experience.  If legal action is not taken before the sheriff sale date, the home will be lost and there is nothing you can do.  It is very important to understand that there are legal options available to resolve a foreclosure and stop a sheriff sale, but legal action must be taken immediately before it is too late.  Filing bankruptcy will give you protection under the Federal government.  Filing bankruptcy can help you save your home from foreclosure if you want to keep the property or eliminate the debt owed if you simply want the property off your hands.  Filing bankruptcy will automatically stop a foreclosure and sheriff sale.  There are many legal options available between both Chapter 7 and Chapter 13 bankruptcy.  An experienced bankruptcy attorney can tailor a bankruptcy around your unique situation and will ensure that your rights are protected.

I Tried Working With the Bank, but the Bank Was Not Able to Help Me

Many times calls to banks go unreturned and loan modifications are often denied. Federal bankruptcy laws are set in place to help you when creditors won’t. Sometimes things are out of your control. No one can help falling behind on mortgage payments because of unemployment, underemployment, medical problems, or having to pay for unexpected expenses. Many times banks will tell folks to stop paying on their mortgage only to come to find out that there is a sheriff sale date or the loan modification was denied. When this happens, bankruptcy may be the best and only option available to you. In order to reach the optimum results possible, it is important to take immediate action once you find out that your home is in foreclosure or a sheriff sale date is scheduled. Sheriff sale dates in Franklin County, Ohio can be found at the Franklin County Sheriff’s Office website.

My House is in Foreclosure and I Want to Keep My Home

Filing Chapter 13 bankruptcy would be ideal if you are behind in your mortgage payments and you would like to keep your home. Filing Chapter 13 bankruptcy will cure the arrearages and can help you get current on your mortgage payments. Filing Chapter 13 bankruptcy will stop the foreclosure by Federal law and will eliminate most of your other debts such as credit cards, medical bills, personal loans, utility bills, and items sent to third-party collections. Federal bankruptcy laws are set in place to help you when creditors won’t. Chapter 13 bankruptcy will help put your home back in your hands with a payment you can afford backed by the Federal government.

My House is in Foreclosure and I Don’t Want to Keep the House

Filing Chapter 7 bankruptcy would be a good idea if keeping the house is not an option you would like to explore. Sometimes it is best to give up real estate in a bankruptcy when you are upside down or underwater in the mortgage loan.  If a piece of real estate becomes more of a money pit than an investment, it may be in your best interest to walk away.  Filing Chapter 7 bankruptcy will eliminate the debt owed from a foreclosed property along with most of your other debts or bills.

Received Letter for Payment to Avoid Garnishment in Franklin County Ohio

You may be one of many Americans living in Ohio who have had a lawsuit filed against you and now receiving a letter for a payment to avoid garnishment.  The letter is a notice of court proceeding to collect debt.  What the creditor is trying to do is collect on the debt owed from the lawsuit by either a voluntary payment or an attempt to garnish your wages.   You will usually receive this letter after a lawsuit has been filed and a judgment has been rendered against you.

Once you receive a Notice of Court Proceeding to Collect Debt in Franklin County, Ohio it is a matter of time before your wages become garnished.  If you don’t pay the debt owed from the lawsuit the creditor can garnish your wages up to 25%, seize funds out of your bank accounts, or attach liens to your property.  It is very important that once you receive this notice that you take action immediately before it is too late.  If action isn’t taken within the 15 day window of time, the creditor can legally take money from you essentially without your permission.

Can I Avoid the Garnishment Within the 15 Day Period?

Yes, you can avoid the garnishment within the 15 day period of time. If you don’t have enough money to stop the garnishment, you may want to file bankruptcy. Filing bankruptcy will stop a lawsuit from beginning or continuing. What you would do is file bankruptcy on the debt you were sued over and essentially they cannot collect on a debt that is eliminated in a bankruptcy.  Filing bankruptcy will also eliminate most of your other debts such as credit cards, medical, bills, personal loans, evictions, utility bills, repossessed vehicles, foreclosed properties, and items sent to third-party collections.  You can also eliminate reinstatement fees if you are trying to get your driver’s license back from suspension.

What is a Wage Garnishment?

A wage garnishment is an automatic withdraw of money from your payroll to pay off a debt owed from a lawsuit that was filed against you. As soon as a judgment is rendered against you, the creditor can garnish your wages by law. The creditor can garnish your wages up to 25% in Ohio.  The wage garnishment is sent to your employer and comes directly out of your payroll. This means the money is already taken out of your pay before your pay check is issued or direct deposited into your bank account.  The wage garnishment will continue until the full amount of the judgment is paid or if a bankruptcy is filed.

Will Filing Bankruptcy Stop a Wage Garnishment?

Yes, filing bankruptcy will stop a wage garnishment. As soon as your bankruptcy petition is filed, legal documentation will be sent to your employer and other necessary parties giving them notice that a bankruptcy has been filed and that the wage garnishment must be stopped immediately by Federal law. Filing bankruptcy will stop a wage garnishment by Federal law and will also stop a foreclosure, sheriff sale, and utility disconnection.
